Begin with the work before filing
A project presentation can be available immediately while your petition still needs substantial preparation. Immigration counsel must review personal eligibility and the evidence supporting your funding. Property sales, corporate distributions, gifts or loans can require a carefully documented history.
At the same time, you need to compare offerings and understand how the money will be used. Ask what is ready now, what documents are still missing and who owns each next step. A rushed transfer does not compensate for an incomplete evidence record.
Distinguish a current category from a completed case
A current Visa Bulletin category concerns the availability of visa numbers. It does not mean that USCIS has finished reviewing your petition or that a consulate has completed your interview. The State Department publishes the applicable categories and dates monthly. See the October 2026 bulletin.

Ask for assumptions, not a promised completion date
An adviser may explain the process and identify factors that could affect timing, but the government controls adjudication. Requests for evidence, personal admissibility issues, visa-number changes and appointment availability can alter the path.
Ask anyone quoting a timeline which stage it describes, where the estimate comes from and what it excludes. A petition estimate is not necessarily an estimate for the day your entire family can settle in the US. Build school, housing and business plans with enough flexibility to absorb changes.
Keep the residence and investment calendars separate
A successful EB-5 admission or adjustment begins conditional permanent residence. The later removal-of-conditions filing has its own deadline and evidence requirements. Counsel should track these from your actual immigration record rather than from the date you first contacted an adviser.
Project maturity and repayment are separate. A proposed loan term can be extended under the documents, and repayment may depend on refinancing or an asset sale. Do not fund the next family milestone on the assumption that invested capital will be returned as soon as a petition is approved.
Make a practical planning calendar
- List personal documents and source-of-funds work still outstanding.
- Record the project’s subscription and funding requirements.
- Ask counsel which filing rules and legislative dates affect your case.
- Keep immigration milestones separate from expected liquidity.
- Identify decisions that can wait until approval or admission.
